PRIVACY POLICY AND COOKIE POLICY

SECTION I
General Provisions

The Administrator of the Service is: Marek Mac, conducting business under the name "myERP MAREK MAC" with its registered office in Skórzewo (60-185), at ul. Grafitowa 32/7, with the NIP number: 8512923634, email address: kontakt@myerp.pl (hereinafter referred to as the "Administrator").
All capitalized expressions, as well as other terms contained and used in this privacy policy (hereinafter referred to as the "Privacy Policy"), primarily have the meaning assigned to them in the Privacy Policy, and if undefined in this document, the meaning assigned to them in the Terms of Service, available at: www.myerp.pl/rodo.
This Privacy Policy explains how the Administrator collects, uses, and secures information about Users within the Service, including personal data within the meaning of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons concerning the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (General Data Protection Regulation – hereinafter referred to as "GDPR"), i.e., data that may lead to the direct or indirect identification of a natural person, hereinafter referred to as "Data" or "Personal Data" and other data via cookies.
This document applies exclusively to information collected by the Administrator through the Service or in connection with its operation.
Providing Data is generally voluntary, but it may be a condition for using the Services available within the Service or for using the Service.

Personal Data

Data Administrator
The Data Administrator of Users' personal data within the meaning of GDPR is the Administrator. For matters concerning privacy and Data protection, the Administrator can be contacted at kontakt@myerp.pl.

Data Collection Method
User data is collected:

  • when the User provides it themselves, e.g., using the Service or Services (e.g., by filling out a form within the Service),
  • through cookies – functional files necessary for the operation of the Service, which automatically collect Data, or other files – only if the User consents to their functioning.
    The Data will not be the basis for automated decision-making but may be subject to profiling for statistical and marketing purposes, which may lead to the customization of commercial offers and advertisements displayed according to User preferences, as well as serve for analytical and statistical purposes.

Purposes, Legal Bases, and Duration of Data Processing
Providing Data is voluntary, but may be necessary to use the Service and execute the Services. Data is collected on the following legal bases and for the following purposes:

  • based on Article 6(1)(a) of the GDPR (consent) – to use optional cookie functionalities (described in detail in §8 of the Privacy Policy), when the User consents to their activation,
  • based on Article 6(1)(b) of the GDPR (contract performance) – to enable Users to use the Services based on agreements concluded per the Terms of Service, including the performance of the electronic service provision agreement,
  • based on Article 6(1)(c) of the GDPR (legal obligation) – to fulfill the Administrator's legal obligations, including consumer law regulations (e.g., handling complaints), performing accounting settlements, responding to requests and demands under GDPR,
  • based on Article 6(1)(f) of the GDPR (legitimate interest) – in the legitimate interest of the Administrator, i.e., to respond to User inquiries, requests, or reports of rights or property violations, for statistical and analytical purposes, potential defense or pursuit of claims, and direct marketing, as well as to enable Service use, i.e., flawless presentation and optimization of the Service (mandatory cookies).

Consent for Email and Telephone Contact
Based on Article 6(1)(a) of the GDPR (consent), the User agrees to email and phone contact for informational, marketing, and Service-related purposes. Data will be retained for the following duration:

  • Data related to responding to inquiries, requests, and demands – for as long as necessary to provide a response, and after this time, may be processed for the limitation period of any claims,
  • Data processed in connection with legal obligations – for the duration required by applicable law or until such obligations are fulfilled, but no longer than the period during which the Administrator may face legal consequences for failing to fulfill the obligation,
  • Data processed to defend or pursue claims – for the period specified by the law for the limitation of each type of claim,
  • Data processed in connection with enabling the use of the Service (mandatory cookies) – for the period specified in §8 of the Privacy Policy,
  • Data processed due to granted consent for enabling optional cookies – until consent is withdrawn,
  • Data collected for statistical and analytical purposes – for 14 months from their collection unless applicable law requires the Administrator to retain the data for a longer period.

User Rights Regarding Data Processing
Users have the right to:

  • access their Data content, including requesting copies,
  • correct inaccurate Data and request supplementation of incomplete Data,
  • delete Data ("right to be forgotten") under certain circumstances outlined in GDPR,
  • restrict processing under specific conditions,
  • Data portability where applicable,
  • withdraw consent at any time when processing is based on consent, without affecting the lawfulness of processing before withdrawal.

Users have the right to file a complaint with the data protection authority (President of the Personal Data Protection Office) if they believe their data processing violates GDPR or other laws.

Entities Receiving Data
When using the Report Service (www.myerp.pl/raport) and calculator (www.myerp.pl/kalkulator), Data provided in the Report may be shared with the Administrator's Partners if the User consents to such sharing, for selecting an appropriate system, enabling the Partner to send an offer, etc. Data will be disclosed to other entities only as necessary to achieve the purpose for which they were provided, under appropriate data processing agreements.

SECTION III
Cookies

The Administrator hereby informs that it uses cookies, small files placed on the User's end device when using the Service. Cookies are used to store information for advertising, functional purposes (to make the site faster and more convenient), saving preferences, and personalizing the Service for displayed content and statistical purposes – which allows the Service to function correctly and to tailor it to the needs of recurring visitors. Cookies may also be used by advertisers collaborating with the Administrator and by research companies.
